Fair Use Policy

1. Purpose and Scope
This Fair Use Policy ("Policy") establishes guidelines for responsible, equitable use of NextCalm resources. While NextCalm is designed to accommodate a wide range of user needs, we must ensure that all users have equal access to system resources and that the Service remains stable and secure for everyone.
This Policy applies to all users of the Service, regardless of subscription tier. Violations of this Policy may result in account restrictions, temporary suspension, or permanent termination, at our sole discretion.
2. Vault Access and Data Management
NextCalm provides unlimited encrypted storage for your personal information. You can store as much information as you need in your Vault without worrying about storage limits.
3. Bandwidth and API Usage
3.1 Data Transfer Limits
To ensure system stability, we enforce reasonable limits on data transfer (bandwidth) and API requests. These limits vary by subscription tier and are designed to accommodate normal usage patterns while preventing abuse.
3.2 Normal Usage
Normal usage includes:
- Daily synchronization of your Vault across devices (1-5 times per day)
- Uploading documents, files, and information to your Vault (several uploads per day)
- Accessing and downloading your Vault content (multiple times per day)
- Sharing encrypted information with designated recipients (within subscription limits)
3.3 Excessive Usage Detection
We monitor for patterns that suggest excessive or abusive usage, such as:
- Continuous synchronization (dozens of times per hour)
- Rapid, repetitive API requests (more than 1000 per hour)
- Attempting to download entire Vault multiple times within short periods
- Using the Service for data hosting or backup services not related to personal information management
- Automated scripts or bots accessing your account without authorization
3.4 Bandwidth Restriction
If we detect excessive bandwidth usage, we may:
- Throttle connection speeds temporarily
- Require manual confirmation before large transfers
- Temporarily restrict API access
- Require you to contact support before resuming normal operations
4. Account Activity and Access Patterns
4.1 Multiple Simultaneous Logins
We allow reasonable concurrent access from multiple devices. However, we monitor for suspicious patterns:
- Logins from more than 10 devices in a 24-hour period may trigger security review
- Simultaneous logins from geographically impossible locations may indicate account compromise
- Logins from a large number of IP addresses may violate our Terms & Conditions
4.2 Account Sharing
Your NextCalm account is personal and for your sole use. Sharing your account credentials with others violates our Terms & Conditions. If we detect multiple individuals using a single account, we may:
- Require password reset and re-authentication
- Restrict simultaneous access from multiple devices
- Suspend or terminate the account
Note: Sharing encrypted Content with recipients is a legitimate feature. Account credential sharing is not.
4.3 Automated Access
You may not use automated scripts, bots, scrapers, or other programmatic means to access your account or the Service without explicit authorization. Exceptions for legitimate use may be requested through our API program (contact api@nextcalm.com).
5. Content Restrictions and Prohibited Uses
5.1 Illegal and Harmful Content
You agree not to store, upload, or manage Content in your Vault that:
- Violates any applicable law or regulation
- Infringes intellectual property rights of others
- Contains child sexual abuse material (CSAM) or exploitative content
- Facilitates trafficking, terrorism, or organized crime
- Violates sanctions, export control, or anti-money laundering laws
⚠️ Serious Legal Consequences
Uploading illegal content, particularly CSAM, will result in immediate account termination and reporting to the National Center for Missing & Exploited Children (NCMEC) and law enforcement. This is a legal obligation, not discretionary.
5.2 Abuse and Misuse
You agree not to use NextCalm to:
- Harass, defame, or threaten any person
- Facilitate fraud, phishing, or deception
- Distribute malware, viruses, or harmful code
- Conduct unauthorized security testing or hacking
- Test our security systems without authorization
- Bypass encryption or security measures
5.3 Commercial Misuse
NextCalm is designed for personal information management, not commercial data storage. Prohibited uses include:
- Using NextCalm as a primary backup service for business operations
- Storing large volumes of non-personal business records
- Using NextCalm to resell or redistribute storage to third parties
- Using NextCalm to compete with our business or services
6. System Resource Usage
6.1 Processing and Computation
While NextCalm provides robust encryption and security features, we must limit resource-intensive operations to prevent system overload. Excessive use of processing-intensive features may be rate-limited, including:
- Batch encryption/decryption operations
- Large file uploads requiring format conversion
- Complex search queries across large vaults
- Simultaneous operations on multiple files
6.2 Network Resources
Our network infrastructure must be shared equitably among all users. Excessive bandwidth usage that impacts other users' experience may be restricted. This includes:
- Continuous large file transfers (maintaining >5 MB/s for extended periods)
- Continuous synchronization across many devices
- Repeated failed connection attempts (brute force indicators)
7. Subscription Tier Restrictions
7.1 Feature Limitations
Different subscription tiers have different feature sets. Fair use requires that you:
- Use features only available in your current tier
- Do not attempt to bypass tier restrictions through technical means
- Do not exploit trial or promotional features beyond their intended scope
- Upgrade if your needs exceed your current tier's capabilities
7.2 All Tiers Equal Access
All subscription tiers have equal access to core NextCalm features including unlimited encrypted storage, unlimited recipients, and unlimited vault management capabilities. Different tiers may offer additional features or priority support, but not reduced data storage or recipient limits.
8. Recipient and Sharing Limits
8.1 Recipient Management
NextCalm allows you to designate recipients to receive encrypted information if needed. Fair use requires:
- Recipients are real individuals with valid contact information
- Recipients have consented to being designated (implicit or explicit)
- You are not adding recipients as a data storage or distribution workaround
8.2 Recipient Management
You can designate as many recipients as needed to receive encrypted information. There are no limits on the number of recipients or recipient groups you can create.
9. Security and Account Integrity
9.1 Failed Access Attempts
We monitor for brute force attacks and unauthorized access attempts. Fair use means:
- Using your own credentials for legitimate access
- Not attempting to access other users' accounts
- Not attempting to guess passwords
- Not attempting to bypass authentication mechanisms
9.2 Security Violations
If we detect security violations, we may immediately:
- Suspend account access pending investigation
- Require password reset and re-authentication
- Enable additional security monitoring
- Terminate the account for serious violations
9.3 Vulnerability Reporting
If you discover a security vulnerability in NextCalm, please report it responsibly to security@nextcalm.com. Do not:
- Exploit vulnerabilities
- Disclose vulnerabilities publicly before we have patched them
- Use vulnerabilities to access other users' accounts
10. Compliance Monitoring and Enforcement
10.1 Monitoring Activities
We monitor account activity to detect and prevent violations of this Policy. Monitoring includes:
- Storage usage analysis
- Bandwidth and data transfer patterns
- Access patterns and login locations
- API request frequency and types
- Error rates and failed operations
10.2 Automated Detection
We use automated systems and manual review to identify potential violations. Automated triggers may result in:
- Temporary throttling of service
- Manual review of account activity
- Notification requiring explanation
- Automatic restrictions pending review
10.3 Enforcement Levels
Violations result in progressive enforcement:
- Warning: Notification of violation with opportunity to correct
- Temporary Restriction: Limited feature access or throttling (1-7 days)
- Suspension: Full account access suspended pending review (up to 30 days)
- Termination: Permanent account closure for serious or repeated violations
10.4 Serious Violations
Certain violations result in immediate termination without warning:
- CSAM or child exploitation content
- Hacking, unauthorized access, or security bypass
- Terrorism or organized crime facilitation
- Sanctions or export control violations
- Fraudulent account creation or payment
11. Appeals and Dispute Resolution
11.1 Appeal Process
If your account is suspended or terminated, you may appeal the decision within 30 days by contacting support@nextcalm.com with "Fair Use Appeal" in the subject line.
11.2 Appeal Requirements
To submit a valid appeal, provide:
- Your account email address
- Detailed explanation of your dispute
- Evidence supporting your position
- Commitment to comply with Policy going forward
11.3 Review Process
Appeals are reviewed within 14 business days. Our decision may result in:
- Reinstatement of full access
- Conditional reinstatement with restrictions
- Maintenance of suspension/termination decision
12. Exceptions and Special Circumstances
12.1 Enterprise Accounts
Enterprise customers with custom agreements may have different Fair Use limits. Your specific agreement takes precedence over this Policy.
12.2 Legitimate Research and Testing
If you have a legitimate need for usage that might otherwise violate this Policy (security research, load testing, etc.), contact api@nextcalm.com to request explicit authorization before proceeding.
12.3 Medical and Legal Professional Use
Healthcare providers and legal professionals managing client information may be eligible for higher limits. Contact support@nextcalm.com to discuss your specific needs.
13. Policy Updates and Changes
13.1 Modifications
We may update this Policy at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect.
13.2 Grandfathering
If policy changes reduce your current usage allowances, we will provide a reasonable transition period (at least 60 days) to adjust your usage before enforcement.
